Количество преступлений следственной группы по делу, связываемому следователями с кооперативом «Бест Вей», множится: 1 декабря Приморский районный суд города Санкт-Петербурга вынужден был признать незаконным фактический отказ кооперативу в ознакомлении с материалами уголовного дела. При рассмотрении дела выяснилось, что следственная группа ГСУ питерского главка МВД, формально руководимая замначальника ГСУ полковником юстиции А.Н. Винокуровым, а фактически — подполковником юстиции Е.А. Сапетовой, подделала документы. Жалоба была подана адвокатом кооператива в июле, много раз ее рассмотрение откладывалось и вот наконец состоялось.

Уличенная адвокатами кооператива в нарушении УПК, следственная группа составила письмо об удовлетворении ходатайства задним числом и попыталась представить дело так, что кооператив не получил письмо по своей вине. Очередная грубая работа, выявленная, как ни парадоксально, в том числе и с помощью системы электронного документооборота самого питерского главка МВД.
Незаконное содержание под стражей

Подделка документов была вынужденным преступлением для сокрытия более серьезного: незаконного содержания под стражей. Если бы следствие 4 июля с. г., как оно пишет в поддельных документах, пригласило кооператив для ознакомления с материалами уголовного дела, оно бы не успело за 30 суток до истечения предельного срока содержания четверых обвиняемых под стражей начать ознакомление обвиняемых с материалами дела, а это было единственное основание продления им срока содержания под стражей.

Следственная группа из-за спешки даже толком не смогла завершить следственные действия, незаконно вела параллельное расследование по «резервному» делу, но сейчас, отбросив стыд, из-за отсутствия материала для составления «нужного» обвинительного заключения, незаконно продолжила расследование «основного» дела. Недавно СГ заявила о новой экспертизе — следственном действии, которое на этапе ознакомления с материалами дела обвиняемых противоречит УПК, предусматривающему четкую этапность завершения предварительного расследования.

Следственная группа могла действовать по закону: просто продлить расследование — но тогда пришлось бы отпускать из-под стражи четверых обвиняемых, что, очевидно, противоречит ее плану держать их в заложниках.

Признание судом первой инстанции незаконности невыполнения 216-й статьи УПК уже сейчас открывает возможности оспаривать октябрьские постановления судов о продлении «стражи» четверым обвиняемым: Уголовно-процессуальный кодекс, как уже было сказано, запрещает нарушение этапности и такое нарушение ведет к тому, что все этапы нужно осуществлять заново, а значит четверых обвиняемых нужно выпускать из СИЗО.

Нет сомнений, что и следственная группа, и прокуратура предпримут меры давления на суд второй инстанции, чтобы максимально затянуть рассмотрение апелляции, и по возможности решение суда первой инстанции отменить или скорректировать. Давить на суд будут всей мощью административного веса руководства ГСУ.

“We've learned from social media that the vaccine is already available,” Emmanuel Fikiri, a nurse working at the clinic that has been turned into a specialist centre to tackle the virus, told the BBC.
He said this was the first time he had treated patients with mpox and every day he feared catching it and passing it on to his own children - aged seven, five and one.
“You saw how I touched the patients because that's my job as a nurse. So, we're asking the government to help us by first giving us the vaccines.”
The reason it will take time to transport the vaccines is that they need to be stored at a precise temperature - below freezing - to maintain their potency, plus they need to be sent to rural areas of South Kivu, like Kamituga, Kavumu and Lwiro, where the outbreak is rife.
The lack of infrastructure and bad roads mean that helicopters could possibly be used to drop some of the vaccines, which will further drive up costs in a country that is already struggling financially.
At the community clinic, Dr Pacifique Karanzo appeared fatigued and downbeat having been rushed off his feet all morning.
Although he wore a face shield, I could see the sweat running down his face. He said he was saddened to see patients sharing beds.
“You will even see that the patients are sleeping on the floor,” he told me, clearly exasperated.
“The only support we have already had is a little medicine for the patients and water. As far as other challenges are concerned, there's still no staff motivation.”

Обзор выступлений свидетелей по уголовному делу. Часть тринадцатая

5 и 12 декабря Приморский районный суд города Санкт-Петербурга, рассматривающий по существу уголовное дело №1-504/24, связываемое с компаниями "Лайф-из-Гуд", "Гермес" и кооперативом "Бест Вей", провел очередные ­заседания, посвященные допросам лиц, признанных следствием потерпевшими, и свидетелей в рамках судебного следствия по делу (обзоры предыдущих заседаний публиковались ранее).

На заседаниях были заслушаны показания граждан — как признанных потерпевшими, так и свидетелей обвинения. В частности, показания Зои Семеновой, которая отказалась от своих показаний, данных во время предварительного расследования, и обвинила следствие в противоправных методах получения показаний.

Предварительное расследование уголовного дела осуществлялось ГСУ ГУ МВД России по Санкт-Петербургу и Ленинградской области. На скамье подсудимых — 10 граждан: Анна Высоцкая (за полгода до ареста уволилась из "Лайф-из-Гуд", до августа 2021 года работала ивент-менеджером "Лайф-из-Гуд", в СИЗО более двух лет), Александра Григорьева (директор одного из "технических" юрлиц "Лайф-из-Гуд", в СИЗО более двух лет), Михаил Измайлов (предприниматель, в СИЗО более двух лет), Елена Соловьева (главный бухгалтер ООО "Эксперт", в СИЗО более двух лет), Альмира Гильберт (неработающая, в СИЗО с 2023 года), Дмитрий Мазанов (предприниматель, в СИЗО с 2023 года), Анатолий Наливан (предприниматель и региональный уполномоченный кооператива, в СИЗО с 2023 года), Денис Шишко (предприниматель, в СИЗО с 2023 года), Дмитрий Выдрин (неработающий, под домашним арестом) и 83-летний отец Романа Василенко, основателя компании "Лайф-из-Гуд" и кооператива "Бест Вей", Виктор Василенко (пенсионер, под запретом определенных действий). Начиная рассмотрение по существу, Приморский районный суд продлил всем подсудимым меры пресечения на полгода, а потом еще на три месяца.

24 октября трое подсудимых: Анна Высоцкая, Александра Григорьева и Елена Соловьева — переведены под домашний арест, остальным подсудимым прежние меры пресечения были продлены на три месяца. Прокуратура оспаривала изменение меры пресечения трем подсудимым, но Санкт-Петербургский городской суд отклонил ее апелляцию.

Всем подсудимым предъявлены обвинения как в мошенничестве (ч. 4 ст. 159 УК РФ) и создании финансовой пирамиды (ч. 2 ст. 172.2 УК РФ), так и в организации преступного сообщества (ч. 3 ст. 210 УК РФ). Их, а также гражданских ответчиков — прежде всего кооператив "Бест Вей" — защищают почти два десятка адвокатов.

В уголовном деле 221 лицо, признанное следствием потерпевшим, предъявляющее претензии как к компании "Гермес", так и к кооперативу "Бест Вей" (для сравнения: у компании "Гермес" не одна сотня тысяч клиентов в России, у кооператива "Бест Вей" — около 20 тыс. пайщиков). Общая сумма ущерба в уголовном деле — 282 млн рублей, при этом на счетах кооператива арестовано около 4 млрд рублей, примерно столько же арестовано на счетах частных лиц.

"Якобы мои показания — фантазии следователя"

Свидетель, приглашенный следствием, Зоя Магомедовна Семенова из Самары, пенсионерка (75 лет), владелица ресторана, является пайщиком кооператива "Бест Вей" и была клиентом компании "Гермес". Подсудимых знает всех, почти всех лично.

"Я была участником и кооператива, и "Гермеса", меня никто не обидел, я никого не обидела. Вначале я в кооперативе была. У меня три кооперативные квартиры, одна из них на внука. В "Гермес" немножко вкладывала. Была консультантом — предлагала и "Бест Вей", и "Гермес", но в моем кругу больший интерес вызывал "Бест Вей". Бонусы были за каждого клиента отдельно. Про "Гермес", про кооператив я знаю на 100% одно: нам никто не говорил — идите берите чужие деньги, завлекайте людей, — рассказывает Семенова. — Наша задача была рассказать человеку, а решение принимал он сам, никто никого не заставлял. У меня есть клиенты, имеющие шесть-семь детей, которые приобрели кооперативную квартиру и сейчас живут в кооперативе. Есть детдомовские, которые в съемных квартирах жили, они приобрели кооперативные квартиры и живут в этих квартирах. Многие участники СВО приобрели квартиры с помощью "Бест Вей". Но многие не успели купить из-за ареста счетов".

"В кооперативе пай накапливаешь — 35%, кооператив добавляет 65%, а потом 10 лет эти средства возвращаются. Мне кажется, "Бест Вей" не связан с "Гермесом" — это две разные организации. Про "Гермес" мало что могу сказать — практически ничего не знаю о нем, — добавляет она. — Об обнаружении признаков пирамиды у кооператива мне стало известно осенью 2021 года. Мне это было удивительно. С 2014 года кооператив успешно работал, все всё видели, никаких нареканий не было".

Прокурор попросил огласить показания, данные на следствии. Galea, an evacuation expert, has conducted research for the UK’s Civil Aviation Authority (CAA) looking at the most “survivable” seats on a plane. His landmark research, conducted over several years in the early 2000s, looked at how passengers and crew behaved during a post-crash evacuation, rather than looking at the crashes themselves. By compiling data from 1,917 passengers and 155 crew involved in 105 accidents from 1977 to 1999, his team created a database of human behavior around plane crashes.

His analysis of which exits passengers actually used “shattered many myths about aircraft evacuation,” he says. “Prior to my study, it was believed that passengers tend to use their boarding exit because it was the most familiar, and that passengers tend to go forward. My analysis of the data demonstrated that none of these myths were supported by the evidence.”
