İzmir'de oturan 3 çocuk annesi D.C.'ye, 31 Mart 2022 tarihinde özel bir hastanede 'yumurtalık kanseri' teşhisi konuldu. Doktorlar tarafından D.C.'ye, 'niraparib' etken maddeli, kutusu 56 bin TL olan akıllı ilacı, ayda yaklaşık 1,5 kutu kullanması gerektiği belirtildi. Ayrıca, D.C.'nin bu ilacı uzun yıllar kullanma ihtimalinin de bulunduğu bildirildi. Yaşlı aylığı ile geçinen D.C., ilacı satın alacak ekonomik gücü olmaması nedeniyle Avukat Murat Turgut Minar'a başvurdu. Sağlık Bakanlığı'nın 29 Kasım 2022 tarihinde endikasyon dışı kullanım izni vererek ilacın tıbben kullanılmasının uygun olduğunu teyit ettiğini belirten Avukat Minar, geçen 6 Aralık'ta SGK'ya başvurarak ilacın bedelinin karşılanmasını istedi. Ancak, SGK'dan bir gün sonra gelen cevapta ilacın bedelsiz karşılanmayacağı belirtildi. Bunun üzerine Minar, 8 Aralık'ta İzmir 1'inci İş Mahkemesi'ne başvurarak, ihtiyati tedbir kararı alınması için dava açtı.
'GECİKME NEDENİYLE YAŞAMINI YİTİREBİLECEĞİ NAZARA ALINMALIDIR'
Avukat Minar mahkemeye verdiği dilekçede, müvekkilinin ekonomik durumunun söz konusu ilacı karşılamaya yetmeyeceğini, yaşlılık aylığı dışında hiçbir gelirinin bulunmadığını belirtti. Tedavinin kesintiye uğramasının geri dönülmez biçimde büyük zararlar doğurabileceğine de dilekçesinde dikkati çeken Minar, "Müvekkilimin, henüz alamadığı önerilen ilacı ivedilikle kullanması gerekmektedir. İlacın kullanım süreci belirsiz olarak önerilmesi nedeniyle D.C.'nin bu külfete ne kadar katlanacağı belirsizdir. Tedavisinin aksaması nedeniyle çok geçmeden yaşamını yitirebileceği de nazara alınmalıdır" dedi.
DAVA SÜRESİNCE SGK TARAFINDAN ÖDENECEK
Dosyayı inceleyen İzmir 1'inci İş Mahkemesi, 1 gün sonra ihtiyati tedbir kararı vererek, dava süresince söz konusu ilacın, SGK tarafından ödenmesine hükmetti. Kararda, Hukuk Muhakemeleri Kanunu'nun 389'uncu maddesi hatırlatılıp, "Mevcut bir durumda meydana gelebilecek bir değişme nedeniyle hakkın elde edilmesinin önemli ölçüde zorlanacağından ya da tamamen imkansız hale geleceğinden veya gecikmesi sebebiyle bir sakıncanın yahut ciddi bir zararın doğacağından endişe edilmesi hallerinde, uyuşmazlık konusu hakkında ihtiyati tedbir kararı verilebileceği' dikkate alınarak ve dosyadaki mevcut deliller göz önünde bulundurmak sureti ile ihtiyati tedbir talebinin teminatsız olarak kabulü gerekmiştir" denildi.
'TÜM VATANDAŞLARIN ÜCRETSİZ ŞEKİLDE İLACA ERİŞMELERİNİ UMUYORUZ'
Avukat Minar, dava sonlandığında da lehlerine bir sonuç çıkmasını ve ihtiyacı olan bütün vatandaşların bu ilaca ücretsiz şekilde erişebilmesini umduklarını belirterek, şunları söyledi:
"Çağımızın en çok can alan hastalıklarından biri olan kanserde; gelişen tıp yeni tedavi süreçlerini de gündeme getirmektedir. Bununla birlikte Sosyal Güvenlik Kurumu'nun da ilaçların ödemelerine ilişkin olarak bulunan yeni tedavi yöntemleri ile aynı hızda kendisini güncellemesi gerekmektedir. Müvekkilin tedavisinde 'akıllı ilaç' teknolojisi ile üretilen bu yeni kanser ilacı her ne kadar Sağlık Bakanlığı tarafından Türkiye'de tedavilerde kullanılmasına izin verilmiş bir ilaç olsa da maalesef Sosyal Güvenlik Kurumu'nun ödediği ilaçlar listesinde bulunmamaktadır. Açtığımız bu davada mahkemece; müvekkilin tedavisinde hayati öneme sahip ilacın dava sonuna kadar tedbiren Sosyal Güvenlik Kurumu'nca ödenmesine karar vermiştir. Bu haliyle dava kanser ilaçlarının ve özellikle akıllı ilaç teknolojisi ile üretilen ilaçların da kurumca ödenmesi hususunda dava sonucu beklenmeksizin ödenebileceğini de göstermiştir."
